3GMagic Terms & Conditions
1. For the purposes of these terms and conditions and reference to “we”, “us” or “our” is 3GMagic, PO Box N19 4DB . We are the promoters of this service. “You”, or “your” refers to you, the purchaser of this service. You must agree with the terms and conditions to receive this service and will be deemed to have accepted these terms and conditions.
2. You must be 18 years or over to subscribe to ‘3GMagic’ (the “service”).
3. The service is currently available to BTcellnet , Vodaphone, Orange, T-Moible contract customers. All messages you receive from the service will be charged at the rate of 38 pence per message, with four messages billed at the rate of £1.50 in advance. All messages you send will be charged at your service provider’s standard text message rate.
4. By replying to the first 3GMagic generated message this implies that you have read and accepted these terms and conditions. By not replying we will assume that you have decided not to take the service.
5. Each time you have sent an answer to a question you may not cancel the text message response from us and you will be charged for that response.
6. To quit receiving texts please send the following message ‘QUIT’ to phone number ‘xxxx’.
7. The service must not be used:
a. fraudulently or in connection with any criminal activity or offence;
b. to send or receive material which is offensive, abusive, vulgar, indecent, defamatory, obscene or in breach or any person’s rights (including without limitation, rights to privacy) or otherwise unlawful;
c. to harass, stalk, inconvenience or cause needless annoyance or anxiety to any person;
d. for commercial purposes or to send unsolicited promotional material or spam; or
e. in breach of any third party’s intellectual rights;
f. to send any software or other communication that contains a virus or other component that is intended to destroy, disable, interrupt or otherwise interfere with the service.
8. We reserve the right to terminate your access to the game for conduct that infringes other users use and enjoyment of the service.
9. You agree to indemnify us against any claims or legal proceeding, which are brought or threatened against us by third parties resulting from your use of the service in breach of these terms.
10. We reserve the right to disclose information about you to applicable regulatory or government bodies where any of your actions have breached these terms of use or where we are required by law to disclose this information.
11. You recognise that the service may be adversely affected by events outside our control from time to time. We will make all reasonable endeavours to ensure the uninterrupted and timely supply of the service and will take
no liability for any error in, delay in or failure in transmission of the service. We will not be liable for any partial or complete failure in the transmission or receipt of SMS text messages.
12. If we believe there has been a breach of these terms and conditions we reserve the right to immediately and without notice withdraw or bar the services.
13. We reserve the right to change these terms and conditions at any time. By continuing to use the service you will be deemed to have accepted the varied terms and conditions, which will be posted on our web site. We reserve the right to cancel, modify or supersede the service, if in our sole discretion, the service not capable of being conducted as specified in these terms and conditions.
14. We do not monitor or control any direct chats you may have with another user via the service nor do we take responsibility or endorse the opinions expressed by other users. We therefore cannot guarantee the quality, accuracy or merit of the content in any direct chat. You are solely liable for all activities while using our direct chat facility and are solely responsible for the consequences of these activities. We will not be liable for any of the content in a direct chat or for any loss or damage incurred by your use of it. Any reliance you place on information sent by other users is at your own risk.
